General Terms and Conditions Pam Goeverneur

In our company, we always use ‘you’ and ‘your’ in our legal documents as well. This document contains the General Terms and Conditions of Pam Goeverneur. Initially, Pam Goeverneur rejects all General Terms and Conditions of other Parties unless otherwise stipulated in the Agreement or these General Terms and Conditions. Also, no other rights can be derived than those stated in these General Terms and Conditions.

  2. Definitions
    • Day: Calendar day;
    • Service: All work, in any form, performed by dietitians for or on behalf of a client. All work, in any form, performed by orthomolecular therapists. Work related to energetic morphological blood tests.
    • Practitioner: Holding a Dutch diploma in orthomolecular therapist and Hormonal health coach.
    • Client: Person to whom a Product or Service is provided;
    • Digital content: Data produced and delivered in digital form;
    • Pam Goeverneur: Seller and practitioner as stated in article 1;
    • Consumer: Any natural person purchasing a Product from the Seller, also including: ‘anyone who does not purchase a Product acting from a profession or business’;
    • Product: Items indicated on the website or in the practitioner’s practice, intended for sale;
    • Practice: The physical location of the Practitioner, where Products are offered, Services are provided, and work is performed.
    • Agreement: Any Agreement that, regardless of how, is concluded between the Seller and the Consumer or the Practitioner and the Client;
    • Parties: Practitioner and Client collectively referred to, Seller and Consumer collectively referred to;
    • Written communication: All communication that does not take place verbally, so digital communication also falls under this formulation.
  3. Applicability
    1. The General Terms and Conditions of ‘Pam Goeverneur’ apply to every Agreement between ‘Pam Goeverneur’ and Client. General Terms and Conditions of any other Party are initially rejected. Only when expressly and in writing agreed upon by the Parties, are the General Terms and Conditions of ‘Pam Goeverneur’ not applicable.
    2. If there is any deviation from one or more provisions of these General Terms and Conditions, the remaining provisions will remain in effect.
    3. Changes to these General Terms and Conditions agreed upon in writing only apply to the specific cases determined in that particular Agreement.
    4. The General Terms and Conditions do not need to be expressly agreed upon again after the first acceptance but are deemed to be tacitly accepted. This applies to all further Agreements between ‘Pam Goeverneur’ and Consumer and ‘Pam Goeverneur’ and Client.
  4. Offer and quotation
    1. ‘Pam Goeverneur’ makes an offer on the website.
    2. The offer described on the website is accepted after payment in the webshop.
    3. Price quotes made on the website include VAT.
    4. The offer made by ‘Pam Goeverneur’ is based on information provided by the consumer.
  5. Agreement
    1. The Agreement between ‘Pam Goeverneur’ and Client is established by offer and acceptance (article 6:217 of the Dutch Civil Code). The Agreement can only be concluded in writing.
    2. Only after written agreement between ‘Pam Goeverneur’ and Client will ‘Pam Goeverneur’ proceed with the execution of the Agreement.
    3. A confirmation of the Agreement is always sent via email.
    4. Changes and/or additions to the Agreement are not possible.
    5. The assessment of whether ‘Pam Goeverneur’ has failed to fulfill one or more obligations (from the Agreement) is up to ‘Pam Goeverneur’. All work is performed based on data provided by the Consumer.
  6. Execution of Agreement
    1. ‘Pam Goeverneur’ ensures that a delivered Service complies with the Agreement. The assessment of whether the Services delivered by ‘Pam Goeverneur comply with the Agreement is up to ‘Pam Goeverneur’.
    2. ‘Pam Goeverneur’ executes the Agreement with the data information from the Client.
    3. If the Client is dissatisfied with the work delivered by ‘Pam Goeverneur’, the Client cannot claim a refund of the amount paid for the work. After all, ‘Pam Goeverneur’ always performs work based on provided data.
    4. ‘Pam Goeverneur’ will always exercise care when executing the Agreement.
  7. Delivery
    1. Before a Product purchased via the website is shipped, the Consumer must pay the full purchase amount.
    2. The purchase amount must be paid in full in the manner indicated on the website before the Product is shipped.
    3. The shipping costs are borne by the Consumer. These costs must be paid simultaneously with the purchase amount of the Product(s).
    4. Shipping and delivery always take place to the address provided by the Consumer. ‘Pam Goeverneur’ cannot be held liable for (financial) damage resulting from incorrect address information. The Consumer is always responsible for providing the correct information.
    5. Blood test results can take 4 to 5 weeks.
  8. Prices
    1. The price for the Services to be delivered is the price listed on the website of ‘Pam Goeverneur’ or the offer from ‘Pam Goeverneur’
    2. ‘Pam Goeverneur’ reserves the right to change prices listed on the website.
    3. Delivery prices depend on the purchased items. These are shown to the Consumer in the shopping cart on the website.
    4. The price for the Services to be delivered is the price listed in the price list of ‘Pam Goeverneur’ or the offer/quotation from ‘Pam Goeverneur’. During the period stated in the offer, the prices of the offered Services will not be increased without informing the Consumer.
    5. ‘Pam Goeverneur’ reserves the right to change prices listed on the website.
  9. Payment terms
    1. Unless otherwise agreed in writing, ‘Pam Goeverneur’ uses a payment term of 30 days after the invoice date, within which the payment from the Client must have been received in the indicated account.
    2. If payment is not received within the specified term of 30 days after the invoice date, a payment reminder will be sent.
    3. As long as the Client fails to fulfill their obligations, all costs related to the collection of the relevant claim will be charged to the Client. These costs expressly include collection agency and legal costs.
    4. For purchases via the website, ‘Pam Goeverneur’ requires direct payment via Mollie.
  10. Insurance reimbursement Many health insurers reimburse extra hours of dietary advice if you have supplementary insurance. You do not pay an excess for reimbursement from supplementary insurance. Ask ‘Pam Goeverneur’ or your health insurer for more information.
  11. Returns website
  12. If the Product was purchased via the website of ‘Pam Goeverneur’, the Consumer has the right to return the Product within a period of 14 days without giving reasons.
  13. The cooling-off period mentioned in paragraph 1 starts the day after the Consumer, or a third party designated by the Consumer, who is not the carrier, has received the Product, or:

If the Consumer has ordered multiple Products in one order: the day on which the Consumer, or a designated third party, has received the last Product. ‘Pam Goeverneur’ may refuse an order for multiple Products with different delivery times, provided that the Consumer is clearly informed of this before the order process.
  15. If the delivery of a Product consists of different shipments or parts: the day on which the Consumer, or a designated third party, has received the last shipment or part;
  16. Returns must be made to the address indicated on the website, or if available, to the address indicated on the return form.
  17. As soon as possible, but within 14 days from the day following the notification referred to in article 11.3, the Consumer returns the Product or hands it over to (an authorized representative of) ‘Pam Goeverneur’.
